Transfer of producer responsibility for packaging to a producer organisation – the new terms of contract effective from 1 January 2018

Finnish Packaging Recycling RINKI Ltd administers contracts that allow companies to transfer their producer responsibility for packaging to producer organisations. The terms of contract will change from 1 January 2018. The purpose of the amendments is to clarify the existing contract structure and to facilitate reporting by companies, to clarify the definitions used in the contract and to harmonise the basis for fees.

A company is deemed to have accepted the terms of contract coming into force on 1 January 2018 if it does not within one (1) month after the sending of the terms of contract inform RINKI Ltd in writing that it will terminate its existing contract.

RINKI Ltd sent a newsletter to its member companies at their official postal addresses on 26 September 2017. The contact persons designated by the companies have also been informed via email.

The types of contracts will be clarified

According to the new terms of contract, a company may have a single contract that covers all of the producer’s branches operating under the same business ID or a joint contract that covers other companies as determined in the terms of contract. Due to the clarification of the contract types, some existing contracts will be updated.

A contract does not need to be updated if the company currently has one single producer responsibility transfer contract with its own business ID. Almost 90% of the existing contracts are of this type. These contracts will continue under the new contractual terms from 1 January 2018.

We will inform each company whose contract needs to be updated. In these cases, too, the existing producer responsibility transfer contracts will remain in force until the new contract is signed. In all cases, the old contract will be subject to the new terms from 1 January 2018.

Key changes in the terms of contract

Rinki’s customer fees

Rinki’s annual fee will be called the customer fee. Until now, the annual fee has been a fixed amount depending on the company’s turnover, but this will be replaced by a tonne-based customer fee invoiced on the basis of packaging the company placed on the market the previous year. An annual minimum and maximum fee will be set for the customer fee. The companies’ workload will be lighter as they will no longer have to report their turnover data to Rinki.

Rinki’s 2018 registration fee, customer fees and material-specific recycling fees will be published on the Rinki website at the beginning of October.


The new terms of contract will allow Rinki to carry out inspections and access company information and documents to ensure the accuracy of the packaging information reported. The purpose of the audits is to guide customers in reporting and, thus, to ensure the reliability of the compiled statistics.

Termination of the contract

After the amended terms of contract come into force on 1 January 2018, a contract may be terminated until the end of the year by terminating it no later than six months before the end of the calendar year.

Companies with a turnover of less than one million euros

Companies with a turnover of less than one million euros are not covered by the producer responsibility for packaging. However, companies may wish to enter a contract and benefit from Rinki’s corporate customer service and customer communications. Under the new terms of contract, companies with a turnover of less than one million euros will pay Rinki’s customer fee and material-specific recycling fees.
